1. Overview
These Terms and Conditions (“Terms”) govern your use of the website at www.custom3dprint.co.uk and any services provided under the Custom 3D Print trading name (“we”, “us”, “our”), based in Swadlincote, Derbyshire, United Kingdom.
A “consumer” is an individual acting wholly or mainly outside their trade, business, craft, or profession. Different provisions may apply where you order wholly for business purposes. Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded.
2. Quote requests and orders
Submitting a quote request does not constitute a binding order. Before you place an order, our written quote will set out the contracting trader’s legal identity and postal address, the agreed specification, whether the goods are bespoke, the total price and applicable taxes, delivery costs and arrangements, estimated timing, and payment terms.
An order is only formed when:
- You have received and reviewed our written quote
- You have confirmed in writing (by email) that you wish to proceed
- We have confirmed acceptance in writing
We reserve the right to decline any quote request without obligation to provide a reason.
3. Pricing and payment
All prices quoted are in GBP (pounds sterling) and include VAT where applicable. Quoted prices are valid for 14 days from the date of the quote unless otherwise stated. Delivery costs are shown separately in the quote. Payment terms will be stated in the quote or agreed prior to commencement of work. We reserve the right to require payment or deposit prior to commencing printing.
4. Files and intellectual property
By uploading a 3D model file or other design file, you confirm that:
- You own or have the right to use the file for printing purposes
- The file does not infringe any third-party intellectual property rights, patents, trademarks, or copyrights
- You grant us a limited licence to use the file solely for the purpose of fulfilling your order
We do not retain your files beyond what is necessary to fulfil the order. We do not reproduce, sell, or share your files with any third party except where required by law. You retain full intellectual property ownership of files you submit.
We will not knowingly print items that infringe third-party intellectual property rights. We reserve the right to refuse orders that we reasonably believe involve infringement.
5. Suitability and limitations of FDM printing
Our parts are produced using FDM (fused deposition modelling) technology. By placing an order, you acknowledge and accept that:
- FDM-printed parts have visible layer lines and surface texture inherent to the process
- Dimensional accuracy is typically ±0.2 mm for well-prepared files, but varies with geometry, material, and orientation
- FDM parts are not certified for safety-critical, structural, medical, electrical, food contact, pressure-vessel, or regulated applications
- General material information on this website is guidance rather than a specification for your particular application; any agreed requirements will be recorded in the quote
- Parts produced are not OEM items and are not tested to any manufacturer specification
- You must tell us before ordering about any particular purpose or essential requirement on which you intend to rely
Nothing in this section excludes our legal obligation to supply goods that are of satisfactory quality, as described, and fit for a particular purpose that a consumer makes known to us and reasonably relies on us to assess.
6. Delivery
Estimated dispatch and delivery dates are given at quote stage. Unless another delivery period is agreed with you, consumer orders will be delivered without undue delay and no later than 30 days after the contract is formed.
If an event outside our reasonable control delays delivery, we will contact you as soon as reasonably possible and take steps to minimise the delay. Your statutory rights concerning late delivery are not affected.
For consumer orders, risk of loss or damage remains with us until you, or a person you identify, takes physical possession of the goods. If you independently arrange a carrier that we did not offer as an option, risk passes when the goods are delivered to that carrier. For business orders, any different delivery and risk terms will be stated in the written quote.
7. Returns and refunds
Change-of-mind cancellation
The statutory 14-day change-of-mind cancellation right does not apply to goods that are genuinely made to your specifications or clearly personalised. We will identify bespoke goods in the written quote before the order is formed. This exception does not apply merely because an item is produced after an order where it is assembled only from standard choices.
If the goods are not made to your specifications or clearly personalised, a consumer ordering at a distance may normally cancel from the date of the contract until 14 days after receiving the goods. To cancel, email us a clear statement at info@custom3dprint.co.uk. We will provide the applicable return instructions and refund information.
If you ask to cancel a bespoke order before manufacture begins, contact us promptly. Although there may be no statutory change-of-mind right, we may agree to cancellation at our discretion. We may deduct reasonable costs already incurred where the law permits and where those costs have been explained to you.
Faulty, damaged, or misdescribed goods
The bespoke-goods exception does not remove your rights where goods are faulty, damaged in transit, not as described, or otherwise do not conform to the contract. Consumer goods must be of satisfactory quality, fit for any particular purpose made known to us and reasonably relied upon, and match their description.
Depending on the circumstances, consumer remedies may include:
- The short-term right to reject non-conforming goods within 30 days and receive a refund
- A repair or replacement after the short-term right to reject has ended
- A price reduction or final right to reject where repair or replacement is unavailable, unsuccessful, or cannot be provided within a reasonable time without significant inconvenience
Please contact us as soon as reasonably practicable after discovering a problem. Photographs and a description will help us investigate quickly, but failure to contact us within seven days does not remove statutory rights. We may ask for the goods to be returned and will bear reasonable return costs where required by law.
8. Liability
Consumers: we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We do not exclude or restrict liability where doing so would be unlawful, and nothing in these Terms affects your statutory consumer rights. We are not responsible for business losses where you use goods for commercial purposes as a consumer.
Business customers: subject to liabilities that cannot lawfully be excluded, our aggregate liability relating to an order will not exceed the price paid for that order. We will not be liable for:
- Loss of profit, revenue, or business opportunity
- Indirect or consequential loss
- Loss arising from use outside the purpose or requirements agreed in writing
- Loss arising from an error inherent in a customer-supplied file that we could not reasonably be expected to identify
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights that cannot be excluded, or any other liability that cannot lawfully be excluded or restricted.
9. Acceptable use of this website
You must not use this website to submit requests for items that are illegal, infringe intellectual property rights, are designed for harm, or breach any applicable law. We reserve the right to refuse service at our sole discretion.
10. Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory protections provided by the law of your home jurisdiction and may normally bring proceedings in the courts of the part of the United Kingdom where you live. Business disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page reflects the most recent update. Changes apply only to orders formed after the updated Terms are made available, unless a change is required by law or you expressly agree otherwise.
